/how to annul a polish residence card and get a refund?
Thousands of people spend months and years trying to get a residence card, which offers many advantages to foreigners. And some people want to cancel it for various reasons (yeah, it happens too).
Today we will tell you about when it is necessary to cancel your card and how to do it correctly. Also in this article you will find out how to get your money back for the card yourself. Enjoy reading this article!
This may be a strange question for some people, but cases of cancellation of a residence card in Poland are quite common. It is not possible to leave things as they are and just forget about the residence card, it must be cancelled.
Why to cancel a residence card? In fact, everything is simple - some people meet certain circumstances because of which it is necessary to refuse the residence permit. Here are the most basic and popular reasons for cancellation:
Change of employer, place of work or dismissal;
Change of the purpose of your stay in Poland (for example, you decided to quit your studies and start working);
Dismissal from a university if you received a residence card on the basis of your studies;
You have closed your business, on the basis of which you received residence permit in the country.
The grounds for annulling your Polish residence card in 2023 are simple - you must stay in Poland legally. In other words, you can cancel your residence card if you are in Poland on a legal basis:
Valid visa;
Visa-free regime;
At the time of an epidemic (quarantine);
On an extended visa.
Many people ask the question «can I apply for a new card after cancelling the old one»? Actually you can, but it all depends on your circumstances and specific case.
It is necessary to correctly perform all the following actions in order to successfully cancel the received residence card:
→ Writing an application for cancellation of the residence card. First of all, you need to write an application (Wzór wniosku o umorzenie postępowania) for cancellation of your residence card. You can download the application form by clicking here.
→ Request for issuance of a decyzja. You need to make copies of your cancellation decyzja. IMPORTANT: without a cancellation decyzja, you will not be able to refund the money for the card!
→ Sending the documents to the Urząd Wojewódzki Wydział Spraw Obywatelskich i Cudzoziemców. The completed application and a copy of the refusal decyzja should be sent to the necessary Urząd by registered mail with acknowledgement of receipt. You can find the address of your city Urząd on the official website. For example, here you can see all the necessary information about Urząd Wojewódzki Wydział Spraw Obywatelskich i Cudzoziemiemców of Łódź.
Do not expect that everything will be very fast. It is even possible that you will have to send these applications to the Urząd all over again, so we strongly recommend that you make photocopies of these applications.
To make this topic much clearer for you, we will give you a simple example:
Today there is no epidemic in Poland and no special quarantine conditions apply. You are a citizen of another country and your visa has expired, but you have already applied for a residence card. Suddenly, your life plans change and you want to cancel this card and go home. You should know that from the day of sending the application for cancellation of the card you will be in Poland illegally and you will be deported at the border. What to do then? There is a way out - if you have a new visa or a valid visa free regime, you can return to Poland and cancel your card without being deported.
Firstly, you should write a request for a refund of stamp duty (in this case on the basis of closing the case). To this application we attach the relevant documents, namely:
Copy of the refusal decyzja;
Copy of the receipt for the payment for the residence card (this is a good example that you should keep all important receipts);
Confirmation of the application for a residence card.
All the above documents must be sent by registered mail to the Urząd Miejski to which the payment was made when applying for a residence permit. You can find this information on the fee receipt.
IMPORTANT: According to the Act on Stamp Duty Ustawa o opłacie skarbowej, stamp duty is non-refundable after five years!
Imagine this situation, you are living in Poland legally and have applied for a residence card, and we all know that the process of processing such a case is not the fastest. Your life circumstances have changed and you have decided to refuse your residence card before you have received it.
In this case, you need to write a cancellation of your application for a residence card.
In conclusion, we can say that there are several different reasons for cancelling a residence card, usually it is a change in life. The process of cancelling a residence card and refunding the money is not complicated, but it has its own peculiarities.
